Introduction:



These policies aim to establish controls and standards to regulate the training and education process and to monitor the quality of e-learning and training practices. We will update these policies periodically in cooperation with the concerned and relevant authorities in the Kingdom of Saudi Arabia and take advantage of the best international practices to ensure the continuity of achieving e-training quality control standards.

These Terms and Conditions set out the rules and regulations for the use of AFAQ platform, based in Riyadh.



By registering on the platform, you accept all terms and conditions outlined in this agreement. If you do not, you will not have the right to use the services offered by the platform.




  • Attendance Policy:



 



Attending hybrid lectures via live broadcast in the programs offered by AFAQ platform is equivalent to regular attendance, and 25% of the student's absence is calculated from the hours of attendance in physical and hybrid lectures for denying the student a certificate of attendance and continuous medical education hours (CME).



 



 




  • Account Creation, Registration, and Payment Policy:



 




  1. If you wish to enroll in a paid online course, you will be asked to provide some information related to your purchase, including but not limited to your name on the card, credit or debit card number, and the expiration date of the card.

  2. We have the legal right to choose the payment method, and all information you provide must be correct and complete.

  3. We may use third-party services to facilitate payment and completion of purchases. By providing your information, you grant us the right to provide the information to such third parties subject to the Privacy Policy.

  4. You must pay the full registration fee for the course within 48 hours of registration, or until the time of the activity. If payment is not received within this period, we have the right to cancel the registration.

  5. Once the course registration procedure has been completed and the fee has been received, registrants will receive an immediate notification of successful registration via email along with the purchase invoice.

  6. Receipt of the fee will be confirmed within two working days. If you have not received the confirmation email after two working days, contact us at support@afaq-lms.com

  7. We have the right to refuse or cancel your order at any time for reasons including but not limited to unavailability of the course, errors in the description or price of the product, errors in your order, or other reasons.

  8. We reserve the right to refuse or cancel your order if fraud or a suspicious or illegal transaction is suspected.

  9. We reserve the right to cancel any course you have registered for without your permission and are committed to refunding the canceled course fees within a maximum of two weeks from the date of cancellation.

  10. You can pay the registration fee in cash at the registration desk at the event venue.



 




  • Registration Cancellation and refund:



 




  • If you want to cancel your registration, you must contact us no later than seven working days prior to the start of the course; we will refund your registration fee minus a 25% administration fees.

  • No refunds will be given after the period specified in the previous clause.

  • You can send cancellation requests to support@afaq-lms.com, specifying the name of the registrant, email address, phone number, confirmation number, the amount paid, and the receipt of payment.

  • If the platform lowers the course fee, the person who registered for it before the discount is not allowed to claim compensation for the price difference.

  • If the platform cancels or postpones any activity, we are committed to informing you in advance and you have the right to refund the registration fee either on your bank account or on your wallet on the platform.



 




  • CME registration Policy:



If you attend training courses or other health events through AFAQ platform, CME registration for health practitioners will be subject to the following conditions approved by the Saudi Commission for Health Specialties:




  • The practitioner must attend at least 75% of the duration of the activity to obtain continuing education hours.

  • CME hours are not registered for any participant (with or without fees) if he missed the event or his absence exceeds the allowed limit estimated as 25% of the event duration, and he has no right to claim continuing education hours.

  • The platform is not responsible for registering the CME hours if the practitioner’s specialty is not among the event’s targeted specialties, and the responsibility lies with the practitioner who willingly joins the event.

  • The platform is not responsible for the trainee not obtaining CME hours because he attended another activity at the same time.

  • The platform is not responsible for a practitioner not obtaining CME hours due to the expiration of his SCFHS license.

  • The platform is not responsible for trainees not obtaining CME hours due to an error in the practitioner's number registered on the platform, and the practitioner is responsible for the accuracy of his data.



 



 



 




  • Content Policy:



 




  • You are responsible for the information that you post, link to, and share on the AFAQ Platform, including its legality, reliability, suitability, accuracy, quality, integrity, right to use, and intellectual property rights.

  • By posting on or through AFAQ System, you acknowledge and warrant that: (i) the posted content is your property (you owe the intellectual rights), you have the right to use it, and the right to grant us the rights and license as outlined in these Terms. (ii) Your Content does not violate the privacy rights, rights of publicity, copyright, contract rights, or any other rights of any person or entity; we reserve the right to terminate the account of anyone found to have infringed copyrights.

  • AFAQ platform has the right to monitor and edit all materials provided by the trainer and has the right to refuse or remove any content that does not suit us, violates any of our policies, or is harmful in any way. You also allow us to use, reproduce, modify or publish the materials you create or store in your account for commercial, marketing, and other purposes.

  • AFAQ has the property of all existing content and can only be used with prior permission. You are not allowed to share, modify, transmit, reuse, download, republish or copy (whether in whole or in part) any Content for commercial or personal benefits, without our prior written permission.



 




  • Prohibited Uses:



You are only permitted to use the services of AFAQ platform for lawful purposes and in accordance with the terms and conditions outlined in this agreement.



 



 



You agree not to use AFAQ platform in a way that:




  • Violates any national and international regulations, rules, and laws.

  • Exploits, harms or attempts to exploit or harm minors by exposing them to inappropriate content.

  • sends or purchases any advertising or promotional materials, including junk mail, spam, or other similar temptation.

  • Impersonates the company, the company's employee, another user, or any other person or entity or attempts to impersonate the company.

  • Violates the rights of others, such as threats and fraud.

  • Abuse, insult, harm, defamation, intimidation, discrimination based on sex, sexual orientation, religion, race, age, national origin, or disability.

  • Participates in other actions that restrict or prevent anyone from using and enjoying the Services, harm or offend the Company or users, or expose them to liability.

  • Disrupts, overburdens, damages, or interferes with any other party's use of the Services, including their ability to engage in real time activities through the Platform.

  • Uses a robot, device, process, or other automated means to access the Service for any purposes, including monitoring or copying material on the Service.

  • Uses any manual processes to monitor or copy any material on the Service or for any other unauthorized purpose without our prior written permission.

  • -Applies any hardware or software that interferes with the proper functioning of the Service.

  • Violates the intellectual property rights of the Platform or of others.

  • Introduces any viruses or other programs that harm the technological environment.

  • Circumvents the security features of the Service through any other websites, software, or Internet applications.

  • Attempts to gain unauthorized access to interfere with, damage, or disrupt any part of the Service, the server on which the Service is stored, or any server, computer, or database related to the Service.

  • Penetrates the Service by any illegal means, method, or technique.

  • Takes any action that could damage or discredit the reputation of the platform.



 




  • Analytics:



We may use third-party service providers to monitor and analyze the use of our Service.



 




  • Intellectual Property Rights:



“Intellectual Property Rights” means all current and future rights granted under global law along with any related copyright, trademarks, designs, and patents. We have the right to bring a claim for infringement of those rights or privileges in each case whether registered or unregistered and any other consequences related to intellectual activity in any part of the world.



 




  • AFAQ owns all the rights to the electronic materials.

  • The trainer/expert is committed to the property rights of the content and its use as per the purposes of the platform only, and we are not responsible for any other uses.

  • If you use open content, you must mention the source.

  • If the Trainer uses content that does not belong to the intellectual property of the platform, the trainer assumes full responsibility.

  • This Agreement does not transfer any intellectual property owned by AFAQ Platform or a third party, and all rights are reserved between the relevant parties and will remain solely with the Platform. This Website or this Service contains trademarks, graphics, or logos that are registered trademarks of the Website operator or its licensors or may be trademarks of other third parties. Your access to use this website and the other related services does not grant you any right to reproduce or use any third-party website operator or trademarks.

  • The Service, the original content (excluding content provided by the instructors), features, and other functionality will remain the exclusive property of AFAQ Platform and its licensors and protected by copyright, trademark, and other laws in foreign countries. It is prohibited to use our trademarks with any product or service without prior written permission of the platform.

  • The data presented on the Platform, including digital content, enrichment materials, or educational resources, are reproducble in the context of the powers granted to registrants and under the policies and conditions of use listed on the Platform, and such data is directly related to the owner of the Platform, so the process of using it is subject to copyright and ownership.



 




  • Copyright Policy:



 




  • It is forbidden to post any content that exposes or shows other people or organizations in a bad way.

  • It is prohibited to infringe the content of intellectual rights by publishing or quoting without permission or consent.

  • It is prohibited to post any content that violates religious or moral values.

  • It is forbidden to publish any content that affects national unity (racial, tribal, sectarian).

  • It is forbidden to publish or promote any content or product with commercial benefits.

  • We respect the intellectual property rights of others, and therefore, it is our policy to respond to any claim that content posted on the Platform infringes the copyright or other intellectual property right ("Infringement") of any person or entity.

  • If you are the copyright owner or have authorization on behalf of the owner, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, then please email the claim to support@afaq-lms.com with the subject line: "Violation Copyright" and a detailed description under the DMCA Copyright Infringement Claims Notice and Procedures.

  • The copyright infringer will be responsible for the resulting consequences (including costs and attorneys' fees).

  • During the activity, the trainer is not entitled to advertise or market his courses or other events that are not affiliated with the Platform.



 



 



 



 




  • SAIP Notice and Procedures for Copyright Infringement Claims:



You can send a notice to the Saudi Authority for Intellectual Property (SAIP) by providing our copyright representative with the following written information (visit the SAIP website for more details https://www.saip.gov.sa ):




  • An electronic or physical signature of the copyright owner or his authorized representative.

  • A full description of the copyrighted work that you claim has been infringed, including a copy of the copyrighted work or the URL (webpage address) of the site where the copyrighted work was posted.

  • Submit the URL or location of the allegedly infringing material on the Service.

  • Address, phone number, and email address.

  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, agent, or law

  • You may not retain any intellectual property right on your comments or feedback.

  • The platform administration may have similar development ideas to your comments.

  • Comments must not contain any confidential information that would violate your privacy or the privacy of a third party.

Although we make regular backups of the Site and Content, these backups are for our administrative purposes and do not guarantee the protection of your data. You are responsible for maintaining your data and we do not offer any kind of compensation for lost or incomplete data if your data is not properly maintained.



We will do our best to ensure complete and accurate backups.

  1. AFAQ platform was established under the laws in force in the Kingdom of Saudi Arabia.

  2. AFAQ Platform has the full authority and legal right to set these terms and conditions.

  3. AFAQ platform has the right to carry out all official business under its licenses from the concerned authorities, and to perform all planned activities in accordance with the rules followed in the laws of the Kingdom of Saudi Arabia.

  4. AFAQ Platform shall take all necessary measures to comply with the terms and conditions of this document and monitor their implementation.

  5. The platform makes no representations, warranties, or conditions of any kind regarding the safety, continued use, accuracy, or reliability of the Services or Materials.

  6. The platform provides the Services as available and disclaims all express, implied, or statutory warranties for the Services against misuse or infringement.

  7. The management of the Platform does not warrant that the content provided through the Services will be uninterrupted, secure, or free of errors, viruses, or other harmful components, nor does it guarantee that any of these issues will be corrected.

  8. The management of the Platform does not deny any warranty or right that it is prohibited from disclaiming under applicable law.



 




  • Limitation of Liability:



 



The management of Afaq platform will not be liable to the trainer or the user for any indirect, incidental, special, concomitant, or punitive damages including damages for loss of profits or goodwill or any other intangible loss resulting from failure to access or use the services for reasons related to legal issues. Our exclusive liability as a platform is limited to the amount paid by the instructor to access the Services and the applicability of the refund policy contained in this document.



 




  • Termination/suspension of the account:



 



The Afaq Platform may terminate or suspend the account of a beneficiary or trainer, and prevent its access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without restriction, including but not limited to breach of the Terms.



 



If you wish to terminate your account, you may only stop using the Service.



 



Certain terms and conditions shall by their nature remain in effect even after account closure, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.



 




  • Governing Law:



 



These Terms shall be governed by and construed under the laws of the Kingdom of Saudi Arabia, without regard to conflict of law provisions.



 



If we fail to enforce any right or provision of these Terms shall not be deemed a waiver of those rights.



 



If any provision of these Terms is deemed invalid or unenforceable by the court, the remaining provisions of these Terms shall remain in effect.



 




  • Dispute Resolution:



 



The laws of the Kingdom of Saudi Arabia represent the exclusive judicial reference in the resolution of disputes, and the courts located in the Kingdom of Saudi Arabia have the right to take measures related to the subject matter of this Law.



 



Thus, the resolution of disputes is subjected to these courts and waives any right to litigate by foreign bodies in any action arising out of or related to these terms, nor does the United Nations Convention on Contracts for the International Sale of Goods apply to this Agreement.



 




  • Changes in the Service:



 



We reserve the right to withdraw or modify our Service or materials we provide via the Service, in our sole discretion without notice. We will have no liability if all or part of the Service is unavailable for any reason at any time.



Occasionally, we may restrict access to certain parts of the Service, or the entire Service, to users, including registered users.
